Indiana AG Hill Affirms Local Governments May Not Regulate Firearm Industry

Over the past week, the National Shooting Sports Foundation® received various reports of local political subdivisions in Indiana overstepping their legal authority and ordering firearm retailers to temporarily close.

Following the quick efforts of the NSSF®, Indiana Attorney General Curtis Hill issued a clarifying opinion, stating that firearm and ammunition-related businesses can remain open.

Attorney General Hill concluded his opinion:
“No unit of government in the State of Indiana has the power to restrict the lawful exercise of the right to bear arms during a state or local emergency. Furthermore, local units are prohibited by Ind. Code § 35-47-11.1-2 and Ind. Code § 10-4-3-33.5 from ordering firearm retailers to close their businesses or in any other way restricting or prohibiting the transfer or sales of firearms during an emergency declaration or otherwise.”

NSSF, on behalf of the entire firearm industry, thanks Attorney General Hill for his swift action and leadership to ensure Hoosiers can continue to exercise their Second Amendment right to keep and bear arms. NSSF urges all members to comply with the requirements of the Executive Order, closely follow CDC guidelines, practice social distancing and take precautions to protect the health of their employees and customers.
