Are You Experiencing ATF Administrative Action As A Result Of The 'ZERO Tolerance Policy'?

NSSF^® has been closely monitoring the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) enforcement of President Joe Biden's announced “ZERO Tolerance Policy,” which is designed to, “target rogue gun dealers.” However, it is our understanding that the total number of FFL revocations has increased dramatically since the ATF recently implemented that policy.

The truth of the matter is that this new policy has forced ATF to proceed with FFL revocations for infractions that at one time warranted only a correction and/or simple ATF citation. In some cases, it has been reported that ATF’s interpretation of this new policy has caused unwarranted revocations. We cannot allow this to proceed unchecked.

• Have you been denied a license or renewal?
• Have you been inspected and received a warning conference or warning letter?
• Have you been inspected, received a warning conference or letter, had the inspection closed out, ONLY to later receive a notice of revocation?
• Have you requested revocation hearing?
• Have you been revoked?
• Have you filed a legal action in federal court to challenge the revocation?

NSSF is calling on those engaged in the industry who are experiencing ATF administrative action (warning conference or revocation) to report their experience to NSSF’s Manager of Legislative & Policy Research, Salam Fatohi. Retailers, Ranges, Manufacturers and the attorneys representing these firms are asked to help NSSF collect aggregate information which we can use to monitor and report on the effects of the “Zero Tolerance Policy.”
