Important Michigan Alert: CORRECTED - New Firearm Safety Law

The Michigan Department of Health and Human Services (MDHHS) recently sent notice about the upcoming enactment date of Michigan Public Act 17 – requiring the secure storage or firearms – going into effect Tuesday, February 13, 2024. The following email notice was sent out by MDHHS to correct an earlier notice. NSSF® urges all Michigan firearm industry members to read the update notice and to click here for more information from MDHHS regarding the new policy.

The Michigan Legislature recently passed Public Act 17 of 2023, which enacts new requirements for individuals to keep unattended firearms unloaded and secured by specific means in MCL 28.429. Significantly, this legislation also amends MCL 28.435 to implement new requirements for federally licensed firearms dealers.

The Michigan Department of Health and Human Services (MDHHS) has resources available to help federally licensed firearms dealers comply with the current requirements to provide certain documents in conjunction with each firearm sale. Learn more information in the press release. Specifically, a federally licensed firearm dealer is prohibited from selling a firearm in Michigan unless the firearm is accompanied with the following:
  • A brochure or pamphlet that includes safety information on the use and storage of the firearm in a home environment.
  • A written warning informing the purchaser of the penalties for failing to store or leave a firearm in the manner required by MCL 28.429. •
  • Lethal means counseling literature published by MDHHS. These documents must be provided free of charge with every firearm sale.
