Ballot Measure 114 Declared Constitutional, BUT NOT YET IN EFFECT

Oregon Appeals Court Declares Notorious Gun Control Measure Constitutional, Additional Review Will Be Sought

Earlier this week, the Oregon Court of Appeals declared that Oregon’s strict gun control ballot measure, Measure 114, is constitutional, reversing a Harney County judge’s earlier ruling that has kept the measure on hold for over two years.

The Oregon DOJ posted this press release on their website, which notes: “Even with today’s decision, the law will not go into effect immediately. Procedural rules give the challengers 35 days to seek further appellate review of the decision.”

The attorney representing two gun owners who challenged the regulations did in fact state he plans to immediately appeal to the state Supreme Court within the 35-day allotted timeframe. “Today, Measure 114 has turned millions of Oregonians into criminals because their right to bear arms has been erased by Oregon's Judiciary,” Tony Aiello, Jr. with Tyler Smith & Associates, P.C., said in a statement. “We intend to appeal this ruling to the Oregon Supreme Court and call on Oregonians for their continued support of this litigation.”

NSSF®, which previously challenged the ballot measure in 2022, is vehemently opposed to Measure 114 and will continue monitoring and provide our members with timely updates as needed.
